There’s a much criticized spending bill with a lot of poison pill provisions and a tiny bit of border wall funding President Trump is expected to sign, and then declare a national emergency to get the wall built.

But they can’t even plan the roll out of a non-binding resolution and some press-release materials? And, when confronted by their own words, their immediate response was to accuse their enemies of sabotaging them? Gosh, by all means, let’s give them control of the entire economy. That couldn’t work out badly. I mean “Mistakes happen when doing time launches like this coordinating multiple groups and collaborators,” when uploading FAQs, not when doing anything as simple as commandeering the bulk of the U.S. economy.

Amazon cancels it’s New York City HQ2 expansion plans. Government shouldn’t be throwing subsidies at targeted corporations (nor picking winners and losers). The decision is also rich, zesty schadenfreude for Rep. Alexandria Ocasio-Cortez screwing over New York Governor Andrew Cuomo and New York City Mayor Bill de Blasio, who both pushed hard for the Amazon deal.
This story should be absolutely infuriating to everyone on all sides of the political spectrum: rather than preserving or processing DNA rape kits, Oklahoma destroyed them.

I know many of you don’t want to hear it, but here in Texas we’re enjoying a comparatively mild winter…
Why President Donald Trump will win the wall fight:
Trump has, however, suggested that he may well go the emergency route if Pelosi and Schumer remain intransigent: “We can call a national emergency. I haven’t done it. I may do it.… It’s another way of doing it.” The standard line trotted out by the Democrats and the media when the President alludes to an emergency declaration is that a phalanx of pettifoggers will contrive to tie it up in the courts indefinitely. This has even been repeated by conservative pundits. According to Professor Turley, however, “Courts generally have deferred to the judgments of presidents on the basis for such national emergencies, and dozens of such declarations have been made without serious judicial review.”
All of which means that there is no practical way for the Democrats to stop Trump from getting his wall. He will make a sound, statesmanlike case for it to the nation during the State of the Union address — just 10 days before the deadline to avoid another shutdown. Nancy Pelosi will be scowling behind him, still smarting from the beating she received in the polls from the last shutdown and the hectoring to which she has no doubt been subjected from vulnerable members whose constituents are tired of, “NO.” Then, failed Georgia gubernatorial candidate Stacey Abrams will deliver the Dem SOTU response and characterize Trump’s wall using the usual tired clichés about racism.
In other words, Trump will have been presidential. He will have delivered all manner of good news about the economy, deregulation, health care, foreign policy, and will have laid out a plan for the wall. The Democrats will have offered identity politics, obstruction, investigations, and magical thinking on policy. Pelosi will at length decide it’s smarter to ignore the crazies in her caucus, give Trump something that he can call a “win” on the wall, and move on to something else… anything else. And all the TDS victims and Never Trumpers will demand to know what happened to their bête noire.

In fact, with all of this year after year of the HOTTEST YEAR EVER, no state has set a highest temperature record is more than 20 years. In fact, most (39 out of 50) state highest temperature records were set quite long ago – over 50 years ago, sometimes as long ago as 1888 (!).
Stop and think about that – if the science were as settled as people say, wouldn’t there be at least one state that set an all time high record recently? What a strange warming that raises average temperatures but not record high temperatures.

Now, Tom Wolfe was a genuine intellectual — he had a Ph.D. from Princeton, for crying out loud — but he was also a Southerner, a native of Virginia, and unlike so many other journalists who have written about the South, he had sympathy for the people he wrote about. He wasn’t out to write an exposé or to do what is nowadays called “investigative journalism,” but sought to explain the folkways of small-town Appalachia to the urban sophisticates who read Esquire, to make the reader see how wholesome and quintessentially American these people really were.
If you want to know why nobody gives a damn about magazines like Esquire anymore, it’s because the progressive politics of the 21st century forbid any sympathy for the kind of people who like NASCAR. Everything in big-league journalism now is about left-wing politics, more or less, and because North Carolina rednecks probably aren’t too excited about the Left’s agenda of open borders and transgender rights and all that, there is zero possibility a latter-day Tom Wolfe could get any New York-based magazine to publish an article like “The Last American Hero.”
The whole thing is basically a celebration of toxic masculinity, as the Gender Studies majors would say. Junior Johnson was not one of these “sensitive” modern guys, but a big muscular fellow who thrived on ferocious competition in one of the most masculine of sports.
He also quotes part of my favorite passage from Wolfe’s celebrated essay, about courage being one of Appalachia’s exportable commodities:
In the Korean War, not a very heroic performance by American soldiers generally, there were seventy-eight Medal of Honor winners. Thirty-nine of them were from the South, and practically all of the thirty-nine were from small towns in or near the Appalachians. The New York metropolitan area, which has more people than all these towns put together, had three Medal of Honor winners, and one of them had just moved to New York from the Appalachian region of West Virginia. If you ignore the MSM-generated drama, 2018 was a great year for America:
In December, the United States reached a staggering level of oil production, pumping some 11.6 million barrels per day. For the first time since 1973, America is now the world’s largest oil producer
Since Trump took office, the United States has increased its oil production by nearly 3 million barrels per day, largely as the result of fewer regulations, more federal leasing, and the continuing brilliance of American frackers and horizontal drillers.
It appears that there is still far more oil beneath U.S. soil than has ever been taken out. American production could even soar higher in the months ahead.
In addition, the United States remains the largest producer of natural gas and the second-greatest producer of coal. The scary old energy-related phraseology of the last half-century—”energy crisis,” “peak oil,” “oil embargo”—no longer exists.
Near-total energy self-sufficiency means the United States is no longer strategically leveraged by the Middle East, forced to pay exorbitant political prices to guarantee access to imported oil, or threatened by gasoline prices of $4 to $5 a gallon.
The American economy grew by 4.2 percent in the second quarter of 2018, and by 3.4 percent in the third quarter. American GDP is nearly $1.7 trillion larger than in January 2017, and nearly $8 trillion larger than the GDP of China. For all the talk of the Chinese juggernaut, three Chinese workers produce about 60 percent of the goods and services produced by one American worker.
In 2018, unemployment fell to a near-record peacetime low of 3.7 percent. That’s the lowest U.S. unemployment rate since 1969. Black unemployment hit an all-time low in 2018. For the first time in memory, employers are seeking out entry-level workers rather than vice versa.
The poverty rate is also near a historic low, and household income increased. There are about 8 million fewer Americans living below the poverty line than there were eight years ago. Since January 2017, more than 3 million Americans have gone off so-called food stamps.
Abroad, lots of bad things that were supposed to happen simply did not.
After withdrawing from the Paris Climate Accord, the United States exceeded the annual percentage of carbon reductions of most countries that are part of the agreement.
North Korea and the United States did not go to war. Instead, North Korea has stopped its provocative nuclear testing and its launching of ballistic missiles over the territory of its neighbors.
Despite all the Trump bluster, NATO and NAFTA did not quite implode. Rather, allies and partners agreed to renegotiate past commitments and agreements on terms more favorable to the U.S.
The United States—and increasingly most of the world—is at last addressing the systematic commercial cheating, technological appropriation, overt espionage, intellectual-property theft, cyber intrusions, and mercantilism of the Chinese government.

The very first bill pushed by House Democrats takes aim at the First Amendment:
House Democrats are up and running, and their first bill is instructive. Couched as an anti-corruption and good-government measure, it is really an attempt to silence or obstruct political opponents.
A central part of H.R. 1 is “campaign-finance reform,” no surprise given the progressive fixation with money in politics, which oddly turns to mist when Tom Steyer or Mike Bloomberg are spending. The House bill requires some advocacy groups to publicly disclose the names of donors who give more than $10,000, even if the groups aren’t running ads that endorse candidates but merely inform voters about the issues.
The goal is to identify donors who don’t genuflect to progressive views, then bully or harass them to stop giving. Recall how the Mozilla CEO was driven out after he donated to California’s referendum opposing same-sex marriage.

Jair Bolsonaro is “far right” and the media means that as a pejorative.
Turns out he favors the private sector and wants to get rid of government owned industry.
He favors expansive gun rights as a way to combat crime and let people protect themselves. This has led to massive media backlash in the United States.
He favors conservative social policy including a rollback of the LGBT agenda in Brazil. Again, this has led to massive media backlash in the United States.
Most damning in the eyes of many in western media, he favors abandoning restrictions on private property that could threaten Amazonian forest growth, i.e. he’s bad for climate change.
The media has focused a lot on Bolsonaro talking favorably about Brazil’s American backed military dictatorship that ruthlessly exterminated communists and other dissident groups from the 1960’s into the early 1980’s. They suggest Bolsonaro might bring it back.
So far, the only thing Bolsonaro seems to be doing is keeping his campaign promises to fight corruption, roll back progressive social policies his socialist predecessor supported, and expand gun rights. But the American commentariat can do nothing but see everything through the lens of Trump and if you hate Trump, you must hate Bolsonaro apparently.
Cahnman says cut Will Hurd some slack on some meaningless political posturing. I tend to agree, especially since here he might actually be voting the way his constituents favor.

President Donald Trump is saying that Democrats missed their window to make a DACA deal.
Monday morning, Trump unleashed a round of tweets blaming Mexico and the Democrat party for contributing to America’s Dreamer crisis, picking up a thread he began Sunday on the same subject.
DACA (Deferred Action for Childhood Arrivals), the controversial policy created extralegally by President Obama, was rightly kicked to the legislature to legally codify protections for individuals who were brought to the U.S. as children without any legal immigration status.
Whether DACA is actually dead, or whether this is just another of President Trump’s persuasion ploys and agreement on those 24-year old “dreamers” can be had in exchange of real border security (e-verify plus a wall plus an end to the diversity lottery plus real enforcement) remains to be seen, but I doubt Democrats will go for it, insomuch as they only care about “dreamers” insomuch as they can keep their base riled up with outrage. They don’t want a narrow amnesty for “deserving” illegal aliens, they want a broad amnesty and an unending stream of illegal aliens to help prop up their electoral chances.
“What Democrats really want aren’t a lot of Hispanics, but an endless firehose of first generation immigrants.” That’s why they’re so fervently against e-verify and a wall. “A wall doesn’t just cut off the pathway of illegal aliens into this country; it cuts off the pathway of the Democrats to their new majority.”
Democrats will continue to favor illegal aliens over Americans until they pay the electoral price for it.

There’s a lot of freaking out over President Donald Trump’s DACA proposal by Republicans who like to freak out over everything Trump says.
You would think, having been through previous freakouts over previous Trump statements, his Republican critics would have learned something by now. Obviously that’s not the case.
His plan would couple the amnesty for Dreamers with a $25 billion request for wall funding, limiting family sponsorship of migration to spouses and minor children, eliminating the Diversity Visa Lottery that gives away immigration passes based on chance, and a number of policy changes to stop abuse of the asylum system and speed deportations of illegal immigrants.
Note that it “would take the immigrants 10 to 12 years to earn citizenship.”
The biggest problem with the proposal is the lack of universal implementation of E-Verify, which would be a cornerstone of any real border enforcement solution. But otherwise there are a number of solid policy ideas for fixing a broken immigration and border control system.
Critics harping on President Trump increasing the number of “dreamers” legalized from 800,000 to 1.8 million are missing the bigger picture. As Rush Limbaugh observes: “I think it was offered knowing that the Democrats would reject this.”
Trump can say, “Hey, I offered it. I’m trying to meet ’em halfway. We’re trying to do something for the kids, and once again it’s the Democrats who say they’re not interested! It’s the Democrats who are walking away.
“It’s the Democrats who cannot accept this seemingly generous offer from the president of the United States.” Chuck Schumer has already rejected it, you just heard Pelosi reject it, and Dick Durbin has rejected it. How many of you were thinking that the Democrats would glom onto this and sign up for it instantly because this would translate to Trump losing? You have to notice that they’re rejecting this. Now, you might say, “Yeah, because they don’t want 1.8! They want 3.6 million. They want 15 million!”
Well, they’re never gonna get that. They’re falling… I think they’re falling into this trap again, and Durbin is being made a fool of… I better stop. I actually should shut up here. I may be giving away too much of the game here to these dingbats. You know, they listen here when they want to. The Democrats have already started smearing Trump’s proposal as white supremacist policy? We’re talking about the DREAMer kids!
Now, part of Trump’s offer does require meritocracy, and that’s what the Democrats can’t stand. That’s another thing. Donald Trump is saying, “We want the best people coming into our country. We want people who love America. We want people who can support themselves. We want people who are gonna become American. We want people are gonna grow our economy.” And what are the Democrats saying? “The hell with that! That’s white supremacy! We need the invigoration that our country gets from immigration.”
They want their permanent underclass. They want the current illegal crop to be granted amnesty. They want nothing more than a never-ending group of people in total dependency, and they are rejecting this. They’ve just been offered a deal that grants amnesty to the children — that’s their number one constituency group, 1.6 or 1.8 million of ’em — and they’re turning it down. They cannot accept it. This is a reasonable offer that the Democrats have to refuse because their prime constituency group is not seen by them as benefiting.

Remember how many observers (especially the #NeverTrump variety) opined that President Trump was mishandling the shutdown and undercutting his Republican allies? How did that work out?
It should be obvious to most observers by now that President Trump argues, debate and negotiates in a way unlike any other President. After some initial stumbles, his unorthodox style has produced obvious results.
President Trump has three big advantages going into any negotiations over DACA:
- The rule of law: Obama’s DACA was illegal in the first place, given how it ignored existing immigration law.
- Republican majorities in the House and Senate: Even if Republican squishes wanted to cave, ala the Gang of Eight, they would still have to convince Republican colleagues to go along with them. (For those who posit that several Republican leaders are just itching to go Full Amnesty, I point out that 2016 happened. For some amnesty was a cynical ploy for more votes, or to avoid getting called racists in the MSM. Neither of those magic spells work anymore. For a Republican in 2018, going full amnesty is tantamount to political suicide.)
- A ticking clock: The DACA reprieve runs out in March, and then deportations start. Democrats can make a deal, or they can watch “dreamers” get deported and get nothing in return, except for the chance to keep pounding them as cynics who spurned his generous offer and don’t really care about “Dreamers” if they can’t harvest them for votes.
There are many scenarios in which Trump wins this fight and gets most-to-all of what he wants on border control, very few where Democrats can even earn a tie, and zero for what Democrats really want (full amnesty, open borders and unlimited “undocumented Democrats” boosting their electoral chances well into the future).
So relax. Trump has this.

Before I moved to Jerusalem, I was very pro-Palestinian. Almost everyone I knew was. I grew up Protestant in a quaint, politically correct New England town; almost everyone around me was liberal. And being liberal in America comes with a pantheon of beliefs: You support pluralism, tolerance and diversity. You support gay rights, access to abortion and gun control.
The belief that Israel is unjustly bullying the Palestinians is an inextricable part of this pantheon. Most progressives in the US view Israel as an aggressor, oppressing the poor noble Arabs who are being so brutally denied their freedom.

IT WASN’T until the violence became personal that I began to see the Israeli side with greater clarity. As the “Stabbing Intifada” (as it later became known) kicked into full gear, I traveled to the impoverished East Jerusalem neighborhood of Silwan for a story I was writing.
As soon as I arrived, a Palestinian kid who was perhaps 13 years old pointed at me and shouted “Yehud!” which means “Jew” in Arabic. Immediately, a large group of his friends who’d been hanging out nearby were running toward me with a terrifying sparkle in their eyes. “Yehud! Yehud!” they shouted. I felt my heart start to pound. I shouted at them in Arabic “Ana mish yehud! Ana mish yehud!” (“I’m not Jewish, I’m not Jewish!”) over and over. I told them, also in Arabic, that I was an American journalist who “loved Palestine.” They calmed down after that, but the look in their eyes when they first saw me is something I’ll never forget. Later, at a house party in Amman, I met a Palestinian guy who’d grown up in Silwan. “If you were Jewish, they probably would have killed you,” he said.

Putin is cozying up Iran just as it’s suffering the same demographic crash affecting so many nations:
Iran is dying, and no one knows it better than Vladimir Putin, who worked successfully to raise Russia’s fertility rate, unlike Iran’s theocrats, who have failed to persuade Iranians to have children.
Russia’s relationship to the only Shi’ite state of significance is less an alliance than a dalliance, motivated by Moscow’s fear of Sunni radicalism and its desire to establish a strategic beachhead in the Middle East.
But Iran is a depreciating asset whose value will disappear within a 20-year horizon. The question is not whether, but at what price Russia will trade it away.

First, Iran may well become the first country in the world that will get old before it gets rich. Its fertility rate (the number of live births over the lifetime of an average woman) fell from 7 in 1979 to perhaps 1.7 today.
That produced an enormous generation of people now in their 20s to 40s who have very few children. As this generation ages, the proportion of Iranians over the age of 60 will soar from about 7% today to around 40% by mid-century.
Other countries face an aging crisis, but with ten times the per capita income: Iran’s nominal GDP per capita is only US$5,300, compared with US$56,000 for the United States, for example.No poor country can care for an elderly population comprising two-fifths of the total. Iran will undergo an economic disaster unprecedented in history. That is baked in the cake, and nothing its government can do will make much different at this late stage.

New York coop provides a microcosm of why Socialism doesn’t work:
The year isn’t off to a good start for the Park Slope Food Coop. In January, two members of the venerable Brooklyn institution were accused of stealing more than $18,000 worth of goods. Each had been caught shoplifting once, and when police consulted surveillance tapes, it turned out that the two men (one of whom was 79 years old!) had some seriously sticky fingers.

In 2013, The New York Times reported the shop lost $438,000 in stolen items.
But that’s only a drop in the bucket compared to the value that’s recently been lost from the coop’s pension fund. The fund — which is for staff, not members — had been invested in small, speculative companies and racked up two years of losses.
According to the Times, “It appears to have gone into hedge-fund mode years ago, when one co-op member, also a hedge-fund investor, made stock-picking his unpaid job.” Last summer, members were told that the coop had to pour in more than $1 million to keep it flush.

President Trump’s first two weeks have been extremely busy, including making good on his campaign promises to secure America’s borders in the form of three Executive Orders:
Executive Order 13767, Border Security and Immigration Enforcement Improvements, which states:
It is the policy of the executive branch to:
(a) secure the southern border of the United States through the immediate construction of a physical wall on the southern border, monitored and supported by adequate personnel so as to prevent illegal immigration, drug and human trafficking, and acts of terrorism;
(b) detain individuals apprehended on suspicion of violating Federal or State law, including Federal immigration law, pending further proceedings regarding those violations;
(c) expedite determinations of apprehended individuals’ claims of eligibility to remain in the United States;
(d) remove promptly those individuals whose legal claims to remain in the United States have been lawfully rejected, after any appropriate civil or criminal sanctions have been imposed; and
(e) cooperate fully with States and local law enforcement in enacting Federal-State partnerships to enforce Federal immigration priorities, as well as State monitoring and detention programs that are consistent with Federal law and do not undermine Federal immigration priorities.
Executive Order 13768: Enhancing Public Safety in the Interior of the United States, which states:
It is the policy of the executive branch to:
(a) Ensure the faithful execution of the immigration laws of the United States, including the INA, against all removable aliens, consistent with Article II, Section 3 of the United States Constitution and section 3331 of title 5, United States Code;
(b) Make use of all available systems and resources to ensure the efficient and faithful execution of the immigration laws of the United States;
(c) Ensure that jurisdictions that fail to comply with applicable Federal law do not receive Federal funds, except as mandated by law;
(d) Ensure that aliens ordered removed from the United States are promptly removed; and
(e) Support victims, and the families of victims, of crimes committed by removable aliens.
Pursuant to which, Executive Order 13768 further states:
Enforcement Priorities. In executing faithfully the immigration laws of the United States, the Secretary of Homeland Security (Secretary) shall prioritize for removal those aliens described by the Congress in sections 212(a)(2), (a)(3), and (a)(6)(C), 235, and 237(a)(2) and (4) of the INA (8 U.S.C. 1182(a)(2), (a)(3), and (a)(6)(C), 1225, and 1227(a)(2) and (4)), as well as removable aliens who:
(a) Have been convicted of any criminal offense;
(b) Have been charged with any criminal offense, where such charge has not been resolved;
(c) Have committed acts that constitute a chargeable criminal offense;
(d) Have engaged in fraud or willful misrepresentation in connection with any official matter or application before a governmental agency;
(e) Have abused any program related to receipt of public benefits;
(f) Are subject to a final order of removal, but who have not complied with their legal obligation to depart the United States; or
(g) In the judgment of an immigration officer, otherwise pose a risk to public safety or national security.
Executive Order 13769: Protecting the Nation From Foreign Terrorist Entry Into the United States, which states:
It is the policy of the United States to protect its citizens from foreign nationals who intend to commit terrorist attacks in the United States; and to prevent the admission of foreign nationals who intend to exploit United States immigration laws for malevolent purposes.
Sec. 3. Suspension of Issuance of Visas and Other Immigration Benefits to Nationals of Countries of Particular Concern.
(a) The Secretary of Homeland Security, in consultation with the Secretary of State and the Director of National Intelligence, shall immediately conduct a review to determine the information needed from any country to adjudicate any visa, admission, or other benefit under the INA (adjudications) in order to determine that the individual seeking the benefit is who the individual claims to be and is not a security or public-safety threat.
(b) The Secretary of Homeland Security, in consultation with the Secretary of State and the Director of National Intelligence, shall submit to the President a report on the results of the review described in subsection (a) of this section, including the Secretary of Homeland Security’s determination of the information needed for adjudications and a list of countries that do not provide adequate information, within 30 days of the date of this order. The Secretary of Homeland Security shall provide a copy of the report to the Secretary of State and the Director of National Intelligence.
(c) To temporarily reduce investigative burdens on relevant agencies during the review period described in subsection (a) of this section, to ensure the proper review and maximum utilization of available resources for the screening of foreign nationals, and to ensure that adequate standards are established to prevent infiltration by foreign terrorists or criminals, pursuant to section 212(f) of the INA, 8 U.S.C. 1182(f), I hereby proclaim that the immigrant and nonimmigrant entry into the United States of aliens from countries referred to in section 217(a)(12) of the INA, 8 U.S.C. 1187(a)(12), would be detrimental to the interests of the United States, and I hereby suspend entry into the United States, as immigrants and nonimmigrants, of such persons for 90 days from the date of this order (excluding those foreign nationals traveling on diplomatic visas, North Atlantic Treaty Organization visas, C-2 visas for travel to the United Nations, and G-1, G-2, G-3, and G-4 visas).
(d) Immediately upon receipt of the report described in subsection (b) of this section regarding the information needed for adjudications, the Secretary of State shall request all foreign governments that do not supply such information to start providing such information regarding their nationals within 60 days of notification.
(e) After the 60-day period described in subsection (d) of this section expires, the Secretary of Homeland Security, in consultation with the Secretary of State, shall submit to the President a list of countries recommended for inclusion on a Presidential proclamation that would prohibit the entry of foreign nationals (excluding those foreign nationals traveling on diplomatic visas, North Atlantic Treaty Organization visas, C-2 visas for travel to the United Nations, and G-1, G-2, G-3, and G-4 visas) from countries that do not provide the information requested pursuant to subsection (d) of this section until compliance occurs.
(f) At any point after submitting the list described in subsection (e) of this section, the Secretary of State or the Secretary of Homeland Security may submit to the President the names of any additional countries recommended for similar treatment.
(g) Notwithstanding a suspension pursuant to subsection (c) of this section or pursuant to a Presidential proclamation described in subsection (e) of this section, the Secretaries of State and Homeland Security may, on a case-by-case basis, and when in the national interest, issue visas or other immigration benefits to nationals of countries for which visas and benefits are otherwise blocked.
(h) The Secretaries of State and Homeland Security shall submit to the President a joint report on the progress in implementing this order within 30 days of the date of this order, a second report within 60 days of the date of this order, a third report within 90 days of the date of this order, and a fourth report within 120 days of the date of this order.
Much has been written abut these executive orders, a great deal of which is wrong:
First, it was not the Trump Administration who selected the seven nations covered by Executive Order 13769, it was the Obama Administration, which in February of 2016 added Libya, Somalia, and Yemen to “Iran, Iraq, Sudan and Syria as countries subject to restrictions for Visa Waiver Program travel for certain individuals.”
Because they were chosen by the Obama Administration, the decision of which countries to include had nothing to do with Trump’s business interests.
It’s not a “Muslim ban”:
What did Trump do? Did he implement his promised Muslim ban? No, far from it. He backed down dramatically from his campaign promises and instead signed an executive order dominated mainly by moderate refugee restrictions and temporary provisions aimed directly at limiting immigration from jihadist conflict zones.
Let’s analyze the key provisions, separate the fact from the hysteria, and introduce just a bit of historical perspective.
First, the order temporarily halts refugee admissions for 120 days to improve the vetting process, then caps refugee admissions at 50,000 per year. Outrageous, right? Not so fast. Before 2016, when Obama dramatically ramped up refugee admissions, Trump’s 50,000 stands roughly in between a typical year of refugee admissions in George W. Bush’s two terms and a typical year in Obama’s two terms.
Despite what various liberal protestors would have you believe, President Trump’s Executive Orders are firmly within the bounds of existing federal immigration laws:
Federal immigration law also includes Section 1182(f), which states: “Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate” (emphasis added).
Section 1182(f) plainly and sweepingly authorizes the president to issue temporary bans on the entry of classes of aliens for national-security purposes. This is precisely what President Trump has done. In fact, in doing so, he expressly cites Section 1182(f), and his executive order tracks the language of the statute (finding the entry of aliens from these countries at this time “would be detrimental to the interests of the United States”).
The mainstream media would like you to believe that Trump’s orders limiting immigration are widely unpopular. That’s not the case:
Politically, the open borders rhetoric helps Trump. Even in California, three-quarters of the population, according to a recent UC Berkeley survey, oppose sanctuary cities. Overall, more Americans favor less immigration than more. Most, according to a recent Pew Research Center study, also want tougher border controls and increased deportations. They also want newcomers to come legally and adopt the prevailing cultural norms, including English.
You know how all your liberal Facebook friends say that “no Muslim refugees” have been involved in terrorism in the United States? That’s false. At least 20 have. Among these lovely individuals was Ramadan Alwan. “He pleaded guilty to conspiring to kill U.S. nationals abroad; conspiring to use a weapon of mass destruction (explosives) against U.S. nationals abroad.” He also “boasted about attacks on American troops in Iraq.”
All of which makes it amazing that unlimited Muslim immigration seems to be the hill liberals want to die on.
Even more ridiculous and blinkered is the suggestion that there may be something unconstitutional about refusing entry to refugees or discriminating among them on religious or other bases (a reaction that was shared at first by some Republicans, including Mike Pence, when Trump’s plan was announced in December 2015). There are plenty of moral and political arguments on these points, but foreigners have no right under our Constitution to demand entry to the United States or to challenge any reason we might have to refuse them entry, even blatant religious discrimination. Under Article I, Section 8 of the Constitution, Congress’s powers in this area are plenary, and the president’s powers are as broad as the Congress chooses to give him. If liberals are baffled as to why even the invocation of the historically problematic “America First” slogan by Trump is popular with almost two-thirds of the American public, they should look no further than people arguing that foreigners should be treated by the law as if they were American citizens with all the rights and protections we give Americans.
Liberals are likewise on both unwise and unpopular ground in sneering at the idea that there might be an increased risk of radical Islamist terrorism resulting from large numbers of Muslims entering the country as refugees or asylees. There have been many such cases in Europe, ranging from terrorists (as in the Brussels attack) posing as refugees to the infiltration of radicals and the radicalization of new entrants. The 9/11 plotters, several of whom overstayed their visas in the U.S. after immigrating from the Middle East to Germany, are part of that picture as well. Here in the U.S., we have had a number of terror attacks carried out by foreign-born Muslims or their children. The Tsarnaev brothers who carried out the Boston Marathon bombing were children of asylees; the Times Square bomber was a Pakistani immigrant; the underwear bomber was from Nigeria; the San Bernardino shooter was the son of Pakistani immigrants; the Chattanooga shooter was from Kuwait; the Fort Hood shooter was the son of Palestinian immigrants. All of this takes place against the backdrop of a global movement of radical Islamist terrorism that kills tens of thousands of people a year in terrorist attacks and injures or kidnaps tens of thousands more.
President Trump is also working to limit immigrants who need welfare.
John Hindraker thinks that President Trump’s orders are only a good first step.
Back in the dim, long ago fairy tale days of 2006, plenty of Democrats voted to build the border fence, including Hillary Clinton, Joe Biden, and Chuck Schumer.
Evidence suggests that Hilary Clinton received 800,000 votes from illegal aliens. Not the three million Trump claimed, but clearly more than the “zero” Democrats falsely claim.
Austin is now ground zero for cutting both state and federal fund for refusing to cooperate in enforcing immigration laws. Expect more detail on this at a future date.
“The House chairman who oversees Justice Department spending is telling so-called ‘sanctuary cities’ that funding for police, jails and housing will end under President Trump’s new executive orders tightening immigration control. ‘It’s real easy, their money disappears. There’s no fight, their money is gone,’ said Texas Rep. John Culberson, chairman of the appropriations subcommittee that funds Justice.” (Hat tip: Director Blue.)
At least one sign that the sanctuary city crackdown is working: Miami-Dade County Mayor Carlos Gimenez has ordered his jail to start cooperating with the INS to deport illegal aliens.
Of course, people working to defy the law and keep illegal aliens from being deported are freaking out over Trump.
Current state of legal play on Executive Order 13769:
It’s unfortunate that Judge [James] Robart’s decision, like the one handed down last weekend in the Eastern District of New York, includes nearly no legal reasoning or explanation, such that we could judge why he found the order unconstitutional or illegal. Federal district judges often issue very summary orders when they are asked to rule on an emergency basis on a request for a temporary restraining order or preliminary injunction, so expecting a scholarly opinion is unrealistic. But with the order halting a nationwide Executive Branch policy in its tracks and sure to be used as a political club, it should not have been too much to ask the court to provide some clue to its reasoning for just saying “this is illegal.”
Fourth, this is a TRO: it applies only until the court can hold a more complete hearing, which it scheduled for Monday.
Byron York also says that the Trump Justice Department demolished Judge Robart’s case.
Other border control actions are going to require congressional approval (including much wider use of E-Verify) and whatever tax changes “make Mexico pay for the wall” (there are ways).
Could Trump’s orders have gone farther? Sure! But it’s a tremendous start for somehow who many in the Republican primaries thought was a secret fan of illegal alien amnesty.
