LinkSwarm for June 11, 2021

Friday, June 11th, 2021

Joe Manchin, controlling the border, and Soros-backed DA’s doing their best to bring back the high crime rates of the 1970s top this Friday’s LinkSwarm:

  • Seems like this should be a bigger story than it is: Mexico just had it’s midterm elections. But that’s not the big part: “97 politicians had been assassinated. Along with almost a thousand being attacked in some way, shape, or form. Just in this election cycle!”
  • West Virginia Democratic Senator Joe Manchin says that he will refuse to vote for the Democratic Voter Fraud Enablement Act of 2021. “I believe that partisan voting legislation will destroy the already weakening binds of our democracy, and for that reason, I will vote against the For The People Act.”
  • Indeed, Manchin just crushed two anti-democratic Democratic power grabs:

Senator Joe Manchin (D-W.V.) will oppose the Democratic Party’s legislation that would federalize elections, the For the People Act, citing the bill’s overtly partisan nature.

Manchin declared his position in an op-ed in the Charleston Gazette-Mail. According to Manchin, “voting and election reform that is done in a partisan manner will all but ensure partisan divisions continue to deepen.”

“I believe that partisan voting legislation will destroy the already weakening binds of our democracy, and for that reason, I will vote against the For the People Act,” Manchin wrote.

Manchin also laid to rest the possibility he would ever support ending the filibuster.

“Furthermore, I will not vote to weaken or eliminate the filibuster,” he said. “For as long as I have the privilege of being your U.S. senator, I will fight to represent the people of West Virginia, to seek bipartisan compromise no matter how difficult and to develop the political bonds that end divisions and help unite the country we love.”

  • Manchin is thwarting The Will of The Party, so naturally Jemele Hill is calling him a racist.

  • Remember how Democrats were sure Hispanics would usher them into permanent majority status? Not in Texas:

Republicans swept key races for mayor in Texas on Saturday, setting back Democratic hopes that the state’s urban areas will deliver statewide majorities for them in the future. Most shocking: In McAllen, Texas, a border city of 150,000 people of which 85 percent are Hispanic, Republicans elected their first mayor since 1997.

Other cities with strong Hispanic populations also elected Republicans to replace retiring mayors. Fort Worth is the twelfth-largest city in the country and has more than 1 million people. Only a third of them are Anglo. But 37-year-old Republican Mattie Parker easily defeated Democrat Deborah Peoples, becoming the youngest mayor of a major Texas city.

The race was ostensibly nonpartisan, but the divisions were clear.

“We’ve never had a race that was this partisan,” Kenneth Barr, the former Democratic mayor of Fort Worth, told Politico. “This particular election has moved as far in the partisan direction as any we’ve ever had.”

Voters also elected Republican Jim Ross as mayor of Arlington, a suburb of 400,000 people that borders Fort Worth and is only 39 percent Anglo. Ross, a former Arlington police officer, was endorsed by several police associations who liked his anti-crime platform. He defeated Michael Glaspie, a former city-council member who was endorsed by the Dallas Morning News and leading Democratic politicians.

But it was the victory of Javier Villalobos in the overwhelmingly Democratic Rio Grande Valley bordering Mexico that shook political observers.

Villalobos, a former chairman of the Hidalgo County Republican Party, defeated Democrat Veronica Vega Whitacre, a fellow McAllen city council member, to become mayor. He campaigned as a conservative and said he wanted to cut water and sewage fees. He called for compassion for undocumented migrants but said the safety of local citizens had to be the first concern. His supporters questioned Whitacre’s wooly-headed claim that if migrants were flowing the other way, toward Mexico, they would be treated with as much compassion by Mexican authorities.

Whitacre’s loss was only the latest sign for Democrats that the Rio Grande Valley is slipping away from them. Biden won the region by 15 points last November, a far cry from Hillary Clinton’s 39-point margin in 2016. At the same time, Congressman Vicente Gonzalez won reelection by only 51 percent to 48 percent over Republican Monica De La Cruz-Hernandez in a district Democrats always carry.

“Democrats have a big problem in Texas,” Rio Grande Valley congressman Filemon Vela told the Texas Tribune in January, shortly after he became vice chairman of the Democratic National Committee. “For the first time in generations, or maybe ever, we lost . . . South Texas counties with significant Hispanic populations,” he said. “And we are going to have to . . . wrap our arms around exactly why that happened. It may be a difficult issue to reconcile.”

It’s not at all difficult to reconcile: The modern Democratic Party’s core policies of racist social justice, anti-police, soft-on-crime and pro-illegal alien are anathema to ordinary middle class Hispanic American citizens. Your ideas are unpopular and you’ll continue to lose as long as you let the radical social justice warriors set the agenda for the party.

  • Meanwhile, since being put in charge of the border crisis, Kamala Harris not only hasn’t visited the border, she laughs off questions about it. (Hat tip: Texas Public Policy Foundation.)
  • Speaking of illegal aliens, the Supreme Court issued a unanimous decision that those who entered the country illegally and were allowed to stay for humanitarian reasons are not allowed to apply for a green card. Also note the Justice Elana Kagan-penned decision makes no mention whatsoever of the “undocumented.” She refers to them, using the standard statutory language, as “aliens.”
  • “LA Sheriff Attributes Crime Surge To Soros-Backed DA Gascón, Supports Recall.”

The city of Los Angeles saw a sharp 36 percent increase in homicides in 2020—but the L.A. County sheriff said this year is looking even more grim, and he’s blaming the widespread uptick in crime on District Attorney George Gascón.

“In 2021, that 36 percent has now become 92 percent, which is a huge statistical jump,” Sheriff Alex Villanueva told The Epoch Times.

“We’re seeing increases in all the categories – assault with a deadly weapon, arson, rape… these things are continuing upward unabated.”

The widespread uptick in crime is the direct result of Gascón’s election as DA of L.A. County and his failure to prosecute offenses, according to Villanueva. Since Gascón took office, 2,690 cases—about 30 percent—“that normally would have gone through were rejected,” he said.

While Gascón has defended his reform policies, criminals in prison are toasting the DA to celebrate their early release, according to officials—and the sheriff said the DA’s policies are making it more difficult for him to do his job.

“You’re supposed to have a district attorney who represents the people … but [he’s] acting like a public defender,” Villanueva said.

“There’s no one left representing the people. I need to work in partnership with the person who’s representing the people. I don’t have that right now.”

  • Speaking of Gascón: “Double murderer approved for parole at third hearing; prosecutors barred from attending under Gascón’s reform.” “Howard Elwin Jones has been imprisoned at San Quentin state prison since 1991 for the December 1988 shooting and killing of 18-year-old Chris Baker and another boy at a party in Rowland Heights.” It appears that there’s nothing Soros-backed DAs enjoy more than putting violent, dangerous felons back on the street.
  • Dozens of Baltimore businesses plan to go Galt:

It comes as no surprise to readers that dozens of Baltimore City businesses, located in the Inner Harbor, in a stretch called “Fells Point,” are threatening the new city government, run by Mayor Brandon Scott, with not paying their taxes because they’re “fed up and frustrated” with the outburst of violence.

In a letter titled “Letter to City Leaders From Fells Point Business Leaders,” addressed to Mayor Brandon Scott, Council President Nick Mosby, Councilman Zeke Cohen, Madam State’s Attorney Marilyn Mosby, and Commissioner Michael Harrison, the 37 restaurants and small businesses are threatening to stop paying city taxes and other fees until “basic and essential municipal services are restored.”

What’s happening in Fells Point, known for its hipster pubs and taverns, as well as delicious seafood from the Chesapeake Bay, is experiencing an overflow of violent crime from other troubled areas.

The letter comes after three men were shot in Fells Point over the weekend.

“What is happening in our front yard — the chaos and lawlessness that escalated this weekend into another night of tragic, unspeakable gun violence — has been going on for far too long,” said the letter.

The 37 businesses are planning to place their city taxes in an “escrow account” and released them until these demands are satisfied:

    • Pick up the trash
    • Enforce traffic and parking laws through tickets and towing
    • Stop illegal open-air alcohol and drug sales
    • Empower police to responsibly do their job

The letter continued to say that minor crime that police “ignore” is what is contributing to more violent crime. So Marilyn Mosby’s halt on prosecuting petty crimes appears to be backfiring.

You don’t say. Baltimore has had a problem with open-air drug markets for over three decades. And the last Republican mayor left office in 1967…

  • Charles C. W. Cooke wonders what use Chris Cuomo is to CNN?

Andrew Cuomo’s little brother is a continuous embarrassment to the cable-news network that employs him. So why does he still have a job?

At this point in the proceedings, one is tempted to conclude that Chris Cuomo must have laced CNN’s corporate offices with dynamite and informed the powers that be that, if he goes, they go, too. What else could explain the network’s eternal tolerance for being embarrassed and degraded by the man? Here, at the tail end of his long experiment in deficiency, Cuomo resembles nothing more keenly than the inadequate tee-baller who gets to stay in past eight or nine strikes because his uncle coaches the team. His ratings are poor. His insights are vacuous. His conduct is a permanent source of ignominy. All the perfumes of Albany could not sweeten this little man. “What’s in a name?” inquired Shakespeare. Little did he know.

It is unclear why Cuomo was selected by CNN to begin with. He’s a lawyer who knows nothing of the law; a journalist who knows nothing of journalism; an American who knows nothing of America. His temper is third-rate, his interests are bewilderingly narrow, he possesses no discernible sense of shame or self-knowledge, and the opinions he proffers are so ruthlessly subordinated to expedience that hypocrisy is his default mode. Ralph Waldo Emerson’s maxim that “a foolish consistency is the hobgoblin of little minds” was meant as an extolment of the virtues of personal growth. Cuomo seems to have taken it literally.

On no single topic has the man’s unique set of professional and personal shortcomings been more obvious than COVID-19. In April of last year, Cuomo’s attempt to fake a two-week quarantine was ruined by his failure to remember that, just a week earlier, he had admitted on the radio that he had left the house to visit a property he owns in East Hampton and gotten into an argument with a stranger. And yet, rather than demote him for telling such a galling and obvious lie, CNN encouraged him to inject his peculiar brand of mendacity into a series of interviews with his own brother. Thus it was that while Governor Andrew Cuomo of New York was making the single worst mistake of the entire coronavirus crisis — herding the elderly into nursing homes and then covering up the death toll — Television Host Chris Cuomo of New York was using America’s most famous cable-news channel to portray him as a national hero. What America needed last year was a dispassionate examination of Andrew Cuomo’s official messaging. What America got was a smirking nepotist brandishing a comedy-sized nasal swab and tweeting obsequious fluff about his sibling. New York, Chris Cuomo concluded, was “doing way better than what we see elsewhere & no way that happens without the Luv Guv dishing the real 24/7.” In exchange, the “Luv Guv” dealt Chris in on a series of private, government-funded COVID tests that were unavailable to everybody else.

Watching Chris Cuomo work is a little like watching a man jump out of an airplane without a parachute and then become irrationally angry at those who tell him he’s going to die.

  • Speaking of CNN, they also brought back Jeffrey “lubin his” Toobin. Proving yet again that the the Democratic Media Complex will alwaqys refuse to apply its rules to their own.
  • Jon Del Arroz wins his lawsuit against Worldcon for calling him racist:

The snowflakes at Worldcon are having a very bad weekend. On Friday, the San Francisco chapter of Worldcon settled a lawsuit and agreed to pay restitution and to issue a public apology for banning conservative author Jon Del Arroz from their convention in 2018 and for besmirching him as a “racist.” Del Arroz is the most dangerous Hispanic voice in science fiction because he refuses to back down in the face of political bullies. He has also written an amazing series, The Saga of the Nano Templar, that my teen daughter is reading for the second time—that’s how good it is—and I don’t have to worry about garbage culture or leftist politics sullying her mind. The Adventures of Baron Von Monacle, a steampunk series, is also highly entertaining. (Always support freedom-loving artists!)

At the time of the banning, Del Arroz was under serious mob attack from social justice warriors trying to drive him out of the sci-fi community. SJWs even sent a spring-loaded exploding can of penis-shaped glitter to his home, which scared his wife and children. The ban came about when Del Arroz asked Worldcon for security measures because he feared for his safety due to the mob-like attacks on him and his family from industry insiders. Instead of helping him, Worldcon banned him and made public statements claiming the author was a “racist” and a “bully,” with no substantiated evidence to back those statements up. I’ve known Del Arroz personally for many years. He is a devout and kind man with a good sense of humor and a love of the art of the troll. He is not vicious, but provocative in a way that is necessary for freedom of speech to be preserved. He’s the one brave enough to exercise the First Amendment in ways that ensure we will keep it. We all need people like Del Arroz in the fight to preserve liberty.

Now we only need about a hundred such lawsuits to force institutional science fiction to regain its sanity… (Hat tip: Stephen Green at Instapundit.)

  • Supreme Court Strikes Down Warrantless Gun Seizure 9-0

    Tuesday, May 18th, 2021

Here’s some welcome news in the form of a rare 9-0 Supreme Court decision upholding Fourth Amendment rights against warrantless gun seizure:

In a unanimous opinion Monday, the U.S. Supreme Court ruled against police who seized a man’s guns without a warrant while he was in the hospital for a suicide evaluation.

Police cannot justify the warrantless search and seizure based on the “community caretaking” exception to the Fourth Amendment, Justice Clarence Thomas wrote in his opinion for the high court.

The Supreme Court had recognized the exception in a 1973 case, Cady v. Dombrowski, in which police searched the trunk of a car that had been towed after a crash.

The Supreme Court ruled Monday in a challenge by Edward Caniglia, who retrieved an unloaded gun during an argument with his wife, put it on the table and said, “Why don’t you just shoot me and get me out of my misery.”

Caniglia’s wife ended up spending the night at a motel. When she called her husband the next day, the wife was unable to reach him. She called police in Cranston, Rhode Island, for a wellness check.

Caniglia agreed to go to the hospital but only after police allegedly promised that they wouldn’t confiscate his firearms. Police entered Caniglia’s home and took two guns.

The 1st U.S. Circuit Court of Appeals at Boston had ruled against Caniglia, ruling that the community caretaking exception applies to homes and cars. The Supreme Court disagreed.

The 1st Circuit’s community caretaking rule “goes beyond anything this court has recognized,” Thomas wrote. “What is reasonable for vehicles is different from what is reasonable for homes. Cady acknowledged as much.”

The full text of the decision can be found here.

The First Circuit’s “community caretaking” rule, how-ever, goes beyond anything this Court has recognized. The decision below assumed that respondents lacked a warrantor consent, and it expressly disclaimed the possibility that they were reacting to a crime. The court also declined to consider whether any recognized exigent circumstances were present because respondents had forfeited the point.

Nor did it find that respondents’ actions were akin to what a private citizen might have had authority to do if petitioner’s wife had approached a neighbor for assistance in-stead of the police. Neither the holding nor logic of Cady justified that approach. True, Cady also involved a warrantless search for a firearm. But the location of that search was an impounded vehicle—not a home—“‘a constitutional difference’” that the opinion repeatedly stressed. 413 U. S., at 439; see also id., at 440–442. In fact, Cady expressly contrasted its treatment of a vehicle already under police control with a search of a car “parked adjacent to the dwelling place of the owner.” Id., at 446–448 (citing Coolidge v. New Hampshire, 403 U. S. 443 (1971)). Cady’s unmistakable distinction between vehicles and homes also places into proper context its reference to “community caretaking.” This quote comes from a portion of the opinion explaining that the “frequency with which . . . vehicle[s] can become disabled or involved in . . . accident[s] on public highways” often requires police to perform noncriminal “community caretaking functions,” such as providing aid to motorists. 413 U. S., at 441. But, this recognition that police officers perform many civic tasks in modern society was just that—a recognition that these tasks exist, and not an open-ended license to perform them anywhere.

    * * *

What is reasonable for vehicles is different from what is reasonable for homes. Cady acknowledged as much, and this Court has repeatedly “declined to expand the scope of . . . exceptions to the warrant requirement to permit warrantless entry into the home.” Collins, 584 U. S., at ___ (slip op., at 8). We thus vacate the judgment below and remand for further proceedings consistent with this opinion.

In some ways this was a very narrowly tailored opinion, in that the Second Amendment was not invoked at all, only the Fourth. And indeed, Justice Samuel Alito’s concurring opinion specifically states that “Our decision today does not address those issues” in relation to the constitutionality of red flag laws. However, the decision was a blow for individual rights against warrentless police seizures in the home. Also, by explicitly including guns as property that is equally protected from such warrentless seizures, the Supreme Court has properly supported Second Amendment rights against the state’s overreach.

Now if they could do something about civil asset forfeitures…

Democrats Full Speed Ahead On Court Packing?

    Thursday, April 15th, 2021

Democrats seem to be hellbent on dismantling the Republic entirely in their relentless quest for absolute power.

Congressional Democrats plan to unveil legislation expanding the size of the Supreme Court on Thursday, according to three congressional sources familiar with the closely held measure.

The bill would add four seats to the high court, bringing the total to 13 from the current nine. The bill is led by House Judiciary Committee Chair Jerry Nadler, Subcommittee chair Hank Johnson, and freshman Rep. Mondaire Jones. In the Senate, the bill is being championed by Ed Markey of Massachusetts.

Never mind that “sainted” Supreme Court Justice Ruth Bader Ginsburg opposed court packing, or that Biden himself denounced the idea back in the Bush43 days:

The question is whether they’re seriously going to try to push this through, no matter how many seats it loses them in 2022, or if this is all a mime show to appease the activist base that demands seizing complete power by any means necessary.

Democratic Senator Joe Manchin of West Virginia has said that he’s still opposed to court packing, as has Arizona’s Democratic Senator Kyrsten Sinema. Then again, these days there are few things more ephemeral than a Democratic office-holder standing on principle against The Will Of The Party.

Just how delusional are Democrats? Certainly the leftwing media bubble lets them continuously get high on their own supply, and they’ve been emboldened since their corrupt push to enthrone Slow Joe over both Bernie Sanders and Donald Trump was a success. (And speaking of Bernie, he was on record as opposing court packing as well.) But surely the more sober party strategists realize they actually lost House seats last year, and outright stole three senate seats between Georgia and Michigan. And all that only got them to 50/50 in the senate. Are they really willing to go all in on court packing when pushing through ObamaCare probably cost them a dozen statehouse chambers for generation?

A worst-case scenario for them would to go all-in on court packing, still come up short, and get slaughtered in 2022…

Supreme Court Strikes Down California’s Church Service Ban

    Saturday, February 6th, 2021

Evidently Americans do continue to enjoy some modest minimum of freedom of religion, as the Supreme Court just struck down California’s ban on indoor church services:

Late Friday evening, the Supreme Court, in South Bay United Pentecostal Church v. Newsom, issued emergency relief suspending California’s broad ban on indoor religious services. The Court ruled that California was “enjoined from enforcing the . . . prohibition on indoor worship services . . . pending disposition of the petition for a writ of certiorari.” The order is limited: Relief was “denied with respect to the [25%] percentage capacity limitations” and denied with respect to the prohibition on singing and chanting during indoor services,” although the Court left the door open to hear any “new evidence . . . that the State is not applying the percentage capacity limitations or the prohibition on singing and chanting in a generally applicable manner.” This lifts some of the most stringent restrictions on religious services in the country. Justices Thomas, Gorsuch, and Alito wanted to grant broader relief on these fronts; Justices Barrett and Kavanaugh thought the evidentiary record was too unclear.

The Court was yet again divided on these issues, but not entirely along the same lines as in prior cases. Chief Justice Roberts, who dissented when the Court ruled against Andrew Cuomo’s restrictions in November, reiterated his view that courts should defer to elected officials and public-health experts, but thought that California had gone too far this time: “The State’s present determination — that the maximum number of adherents who can safely worship in the most cavernous cathedral is zero — appears to reflect not expertise or discretion, but instead insufficient appreciation or consideration of the interests at stake.” Justice Gorsuch argued that California was overgeneralizing the risks of religious services:

California . . . insists that religious worship is so different that it demands especially onerous regulation. The State offers essentially four reasons why: It says that religious exercises involve (1) large numbers of people mixing from different households; (2) in close physical proximity; (3) for extended periods; (4) with singing . . . California errs to the extent it suggests its four factors are always present in worship, or always absent from the other secular activities its regulations allow. Nor has California sought to explain why it cannot address its legitimate concerns with rules short of a total ban . . .

On further inspection, the singing ban may not be what it first appears. It seems California’s powerful entertainment industry has won an exemption. So, once more, we appear to have a State playing favorites during a pandemic, expending considerable effort to protect lucrative industries (casinos in Nevada; movie studios in California) while denying similar largesse to its faithful. . . . Even if a full congregation singing hymns is too risky, California does not explain why even a single masked cantor cannot lead worship behind a mask and a plexiglass shield. Or why even a lone muezzin may not sing the call to prayer from a remote location inside a mosque as worshippers file in.

    Gorsuch concluded:

[California’s] “temporary” ban on indoor worship has been in place since August 2020, and applied routinely since March. California no longer asks its movie studios, malls, and manicurists to wait. And one could be forgiven for doubting its asserted timeline. Government actors have been moving the goalposts on pandemic-related sacrifices for months, adopting new benchmarks that always seem to put restoration of liberty just around the corner. As this crisis enters its second year — and hovers over a second Lent, a second Passover, and a second Ramadan — it is too late for the State to defend extreme measures with claims of temporary exigency, if it ever could. Drafting narrowly tailored regulations can be difficult. But if Hollywood may host a studio audience or film a singing competition while not a single soul may enter California’s churches, synagogues, and mosques, something has gone seriously awry.

The three liberal justices dissented, asserting that the opinions of unelected experts should trump enumerated constitutional rights.

The Trump White House’s List Of Trump’s Accomplishments

    Sunday, January 24th, 2021

I wanted to compile a list of the Trump Administration’s pluses and minuses (and, indeed, still might). One source I was going to draw from was the WhiteHouse.gov list of Trump Accomplishments. However, the Biden Administration took that down. As a service, and for the Historical Record, I’ve fished that list out of the Wayback Machine and am posting it below. (Plus you never know when the Biden Administration might ask the Wayback Machine to remove it from their records.) I’ve even tried to replicate the formatting.

Dear Judicial Watch: Do You Think You Could Stop Mailing Me So Much Crap?

    Saturday, January 2nd, 2021

Throughout 2020, I carried out a little experiment: I saved every single piece of mail I received from Judicial Watch in a stack:

The stack of mail came to about 6 1/2″ high. Each piece had various different ostensible purposes (newsletters, surveys (“NON-TRANSFERABLE POST-ELECTION CRITICAL ISSUES MEMBER SURVEY ENCLOSED FOR JUDICIAL WATCH MEMBER:”), etc.), but they all precisely one real purpose: raising money.

I receive all this mail because I am, in fact, a Judicial Watch member, for which I pay $35 a year. That is, in fact, all I have paid, despite getting this non-stop stream of mail solicitations, because I’m not made of money or an idiot. And I don’t even mind the newsletters. But early this week I received no less than three Judicial Watch mailers.

Judicial Watch does a lot of good work, filing lawsuits that helped bring bring various Clinton, Soros, Biden and Obama scandal information to light. They’re one of the most important conservative organizations waging lawfare.

I understand that the first rule of a non-profit is that you have to make a profit. And I understand that almost every “Conservative Inc.” entity does the same thing. And better to send your money to Judicial Watch than a scam PAC. But it appears that every cent of my $35 (and probably more) was spent sending out mail to solicit more money.

    Some adjustment seems in order.

  • “Ukraine Press Conference Explicitly Ties Hunter & Joe Biden To Corruption“:

A video from a press conference in Ukraine is going viral. It is the follow-up to a video press conference that Ukraine released over a year ago, in which Members of the Ukraine Parliament demanded that President Zelensky and President Trump investigate billions of dollars of corruption in Ukraine that is tied to the U.S. The newly released video is meant to provide documentary and eyewitness information about the corruption – and the Biden family figures prominently in the story.

    Snip.

At one of the first press conferences about a year ago, we showed bank transactions for hundreds of thousands of dollars to the family of former US Vice President Joe Biden, namely to his son Robert Hunter Biden. The latter was a member of the board of directors of the infamous gas production company Burisma.

Burisma belongs to the fugitive Yanukovych-era minister Mykola Zlochevsky.

The inclusion of Biden in the Burisma leadership and payment for his services is nothing more than a political cover that protected Zlochevsky from the Ukrainian law, namely from the criminal code.

Two foreign witnesses whose identities are protected – Witness 1 and Witness 2 – came forward to testify about the facts of the case. Konstantyn Kulyk, the Head of the Group of Prosecutors of the Prosecutor General’s Office of Ukraine, explained what the witnesses offered:

One quote from a statement by a Witness:

“All the described financial transactions were fictitious. And a lot of money was paid in Ukraine so that the state authorities turned a blind eye to it.”

    [snip]

In the period from November 2014 to October 2015, the Witnesses noticed strange recurring payments that, at the direction of Oleh Nelin (Zlochevsky’s assistant in the Verkhovna Rada of Ukraine), were sent from the account of BURISMA HOLDINGS LTD, which was opened for the personal needs of Mykola Zlochevsky, in the Latvian PrivatBank AS to the account of the American company ROSEMONT SENECA BONAI LLC.

The witnesses drew attention to these payments since about 20 times the same uneven amount was recurring – $83,333.33 as payment for consulting services.

    [snip]

In the period from November 2014 to October 2015, the money stolen from Ukrainians, located on account of BURISMA HOLDINGS LTD with the Latvian PrivatBank AS, was transferred to the account of ROSEMONT SENECA BONAI LLC in the American bank MORGAN STANLEY in payments in total amounting to $3.4 million for consulting services.

    And this handy chart:

The broad outlines of this have already been covered here, but the conference filled in some details.

  • Why the Hunter Biden scandal isn’t going away. “That is the problem with a bunker press strategy of denial and isolation. Like water, truth has a way of coming out.”
  • Five great Trump victories in 2020. Including Amy Coney Barrett and peace in the Middle East. (Hat tip: Stephen Green at Instapundit.)
  • Want some brutal truth? Well, sorry, but that’s what’s on the menu:

So I guess there’s going to be a rally in Washington DC on Wednesday, organized by https://stopthesteal.us/. There’s also going to be rallies (protests?) in many state capitols on Sunday as well.

My question is, why? What, exactly, is the point of these demonstrations?

If the purpose is to just gather like-minded people together for one last good time rock and roll bash before the awful, awful Harris-Biden administration sets in, OK, I can see that. Just don’t delude yourself into thinking that something is going to change because of these rallies. No Democratic lawmaker is going to say “hey, look at all of those pro-Trump protestors out there. We’d better not certify the swing-state electors because maybe they’re right about election fraud.”

    They’re not afraid of us.

Because we hold our rallies, listen to the scheduled speakers, clap politely, and march around carrying our protest signs in an orderly fashion, and then go home – after first cleaning up after ourselves.

At these rallies, we don’t wear masks to hide our identity, we don’t slug it out with the police, we don’t assault random passers-by and shout at diners through bullhorns at outdoor restaurants, we don’t vandalize and loot small businesses, we don’t break windows and we don’t cover the place with graffiti. And we don’t walk away from 100 tons of trash, which is the amount the city of Seattle had to clean up when they finally got around to busting up the CHAZ sh*thole last summer.

So why would they listen to us?

I am by no means advocating we start doing any of those things. This is an advantage the other other side has over us that we have to live with: politicians and judges are afraid of their protests, but not ours. Because if a judge rules against them, they’ll show up at his house late at night and threaten him. Nobody wants to have to face that. And I wonder why many of Trump’s election lawsuits got dismissed without so much as looking at the evidence. Is it because of the fear of the consequences if they found in his favor?

My point is, none of these rallies, and I don’t care if they get a million people, two million to show up on Jan. 6th, is going to move the needle in the slightest.

  • Kurt Schlichter has predictions for 2021:

    5. Woke Won’t Work

Slowly but surely, I think people are getting tired of Woke. None of us signed up to be ruled by a bunch of lachrymose sophomores who burst into tears because we insist they use the right toilet. Even liberals are getting sick of constantly having to navigate a minefield of microaggressions – it’s tiresome to always be worried that someone is going to freak out by your perfectly reasonable behavior. Look for a major star of some sort who is too big to cancel to simply refuse to play along anymore, and that may open the door to others. The SJW emperor truly has no clothes, and the second someone points and laughs at his/her/their shriveled junk, the entire country will join in the well-deserved mockery.

    4. The Murder Turtle Will Be Even More Of A Hero Than Dick “The Savior of Saigon” Blumenthal

He’s frustrating, sure, but Cocaine Mitch is the most skillful knife fighter/Senate Majority Leader in American history, and whether or not we win in Georgia next week (I think we will, but not enough to put money on it – just don’t be an idiot and refuse to vote if you dwell in the Peach State), he will be our bulwark against the Democrat onslaught. And by “bulwark,” I refer to a strong, implacable defensive fortification, and not that lame blog written by sexually inadequate sissies that is hoping that the end result of 2020’s election is that they can once again round up suckers to pay good money to take their insipid Conservative Inc. cruises.

However, I doubt his number 1 prediction, that Biden won’t be president by next New Year’s Eve. As bad as Biden’s cognitive decline might be, I have a hunch that both Jill Biden and the DNC cabal that managed to install him will turn the reigns over to Kamala Harris anytime soon.

  • “Floodgates Opening? Student sues over Critical Race Training at Nevada public charter school”:

A Nevada mother has followed through on her threat to file a civil rights lawsuit against her son’s charter school for refusing to let him opt out of a mandatory class that promotes hostility toward whites as a race.

Democracy Prep at the Agassi Campus forced William Clark “to make professions about his racial, sexual, gender and religious identities in verbal class exercises and in graded, written homework assignments,” creating a hostile environment, the biracial high school student and Gabrielle Clark allege in their federal lawsuit filed Tuesday.

The senior’s statements were “subject to the scrutiny, interrogation and derogatory labeling of students, teachers and school administrators,” who are “still are coercing him to accept and affirm politicized and discriminatory principles and statements that he cannot in conscience affirm.”

The suit also names Democracy Prep Public Schools, the New York-based charter network, and several officials in the local school and network as defendants.

One of the earliest signals that 2020 would be a year of mass homeschooling appeared in an April survey of parents conducted by EdChoice. It asked a variety of questions about how families were coping with school shutdowns and revealed that more than half of the respondents had a more favorable view of homeschooling as a result of the school closures. I remember thinking at the time that if families thought homeschooling was tolerable during the springtime tumult and isolation, then they would find it far more fulfilling under ordinary circumstances when they could actually gather with others, visit libraries and museums, attend classes and so on.

In May, a RealClear Opinion Research survey confirmed that many parents were more satisfied with at-home learning than expected, with 40 percent saying they were more likely to choose homeschooling or virtual learning even after lockdowns ended. Around the same time, a USA Today/Ipsos poll found that 60 percent of parents surveyed said they would likely choose at-home learning in the fall rather than send their children to school even if the schools reopened for in-person learning.

As summer began, parent actions reflected pollster predictions. Many parents began pulling their children out of school and registering them as independent homeschoolers. During the first week of July, so many parents in North Carolina submitted their online intent to homeschool forms that it crashed the state’s nonpublic education website. Homeschool applications were up 21 percent in Nebraska in July, and 75 percent in Vermont, while grassroots homeschooling networks and local Facebook homeschooling groups reported record increases in new members.

  • Election Fraud Update for December 21, 2020

    Monday, December 21st, 2020

At this point, I believe there’s less than a 1% chance that the election fraud is overturned and Donald Trump sworn into a second term on January 20. Still, I’m going to go ahead and do another Election Fraud Update for (as Dwight likes to put it) the Historical Record.

    No, not that one

  • Trump campaign files independent lawsuit over Pennsylvania election fraud with the Supreme Court. Given previous results and the lateness of the filing, I’m not overly hopeful. (Hat tip: Director Blue.)

  • Here’s a 30 page report alleging coordinated voting fraud in six states (Arizona, Georgia, Michigan, Nevada, Pennsylvania and Wisconsin):

From the findings of this report, it is possible to infer what may well have been a coordinated strategy to effectively stack the election deck against the Trump-Pence ticket. Indeed, the observed patterns of election irregularities are so consistent across the six battleground states that they suggest a coordinated strategy to, if not steal the election outright, strategically game the election process in such a way as to “stuff the ballot box” and unfairly tilt the playing field in favor of the Biden-Harris ticket.

    Snip.

    • The ballots in question because of the identified election irregularities are more than sufficient to swing the outcome in favor of President Trump should even a relatively small portion of these ballots be ruled illegal.
    • All six battleground states exhibit most,or all,six dimensions of election irregularities. However, each state has a unique mix of issues that might be considered “most important.”To put this another way, all battleground states are characterized by the same or similar election irregularities; but, like Tolstoy’s unhappy families, each battleground state is different in its own election irregularity way.
    • This was theft by a thousand cuts across six dimensions and six battleground states rather than any one single “silver bullet” election irregularity.
    • In refusing to investigate a growing number of legitimate grievances, the anti-Trump media and censoring social media are complicit in shielding the American public from the truth. This is a dangerous game that simultaneously undermines the credibility of the media and the stability of our political system and Republic.
    • Those journalists, pundits, and political leaders now participating in what has become a Biden Whitewash should acknowledge the six dimensions of election irregularities and conduct the appropriate investigations to determine the truth about the 2020 election. If this is not done before Inauguration Day, we risk putting into power an illegitimate and illegal president lacking the support of a large segment of the American people.
  • And here’s an interview with Peter Navarro on the report.
  • “Statistical Model Indicates Trump Actually Won Majorities in Five Disputed States and 49.68 Percent of the Vote in a Sixth.”

We report a simple yet powerful statistical model of county-level voter behavior in the November 2020 presidential election using two main types of data:

    1. County-specific voting data from the five previous presidential elections.
    2. Selected demographic variables (race and education) plotting how different national voter groups voted differently in 2020 overall.

These two types of predictors allow us to explain over 95% of the variation in county-level votes, and therefore allow us identify which counties (and consequently, states) look substantially anomalous in the 2020 election.

The model provides substantial support for the allegation that the outcome of the election was affected by fraud in multiple states. Specifically, the model’s predictions match the reported results in all other states, i.e. states where no fraud has been alleged, but predicts Trump won majorities in five disputed states (AZ, GA, NV, PA and WI) and 49.68% of the vote in the sixth (MI).

In other words, the reported Biden margin of victory in at least five of the six contested states cannot be explained by any patterns in voter preference consistent with national demographic trends.

    SUMMARY OF MAIN ARGUMENTS

    1. Our model explains 96% of county-level variance in Trump’s two-party vote share with four demographic variables (non-college white, college-educated white, black and hispanic) and one historical variable (the average of county-level GOP two-party presidential vote share, 2004-2016). All five variables are highly significant. This reinforces the conclusion that the model is generally a very strong predictor of vote shares, and so deviations from it should be considered surprising.

    2. Under conservative assumptions, regression analysis shows Trump ought to have won AZ, GA, NV, PA, WI.

Remember that statistical models are indicative, but not conclusive.

  • “After Examining Antrim County Voting Machines, ASOG Concludes Dominion ‘Intentionally Designed’ to ‘Create Systemic Fraud.'”

The cyber-security firm that conducted a forensic examination of 22 Dominion Voting tabulators in Michigan has determined that “Dominion Voting System is intentionally and purposefully designed” to “create systemic fraud,” and that election results of Antrim County should not have been certified. Allied Security Operations Group (ASOG) said in a report published Monday morning that it observed an error rate of 68.05 percent in the fatally flawed machines.

Earlier Monday morning, Michigan state judge Kevin Elensheimer ordered the release of the the Dominion voting machines audit in Antrim County, where thousands of votes for President Trump were flipped to Joe Biden.

Last week, Judge Elensheimer issued a protective order allowing Michigan Attorney General Dana Nessel and Secretary of State Jocelyn Benson to temporarily block the results of the audit.

During a hearing conducted by ZOOM and streamed live on YouTube, Elensheimer this morning removed that order, clearing the way for the results to go public with some redactions.

    Snip.

We conclude that the Dominion Voting System is intentionally and purposefully designed with inherent errors to create systemic fraud and influence election
    results.

The system intentionally generates an enormously high number of ballot errors. The electronic ballots are then transferred for adjudication. The intentional errors lead to bulk adjudication of ballots with no oversight, no transparency, and no audit trail. This leads to voter or election fraud. Based on our study, we conclude that The Dominion Voting System should not be used in Michigan. We further conclude that the results of Antrim County should not have been certified.

PHOENIX — The Maricopa Board of Supervisors voted 4-1 today defy the state lawmakers and resist complying with legislative subpoenas. Instead of allowing a transparent audit, the board voted to file a lawsuit against lawmakers in Arizona state court to block the enforcement of the subpoenas.

The Chairman of the Board, Clint Hickman (R), described the subpoenas as unrealistic and unconstitutional.

The subpoenas were issued earlier this week by Arizona lawmakers, who sought to force an audit of Dominion voting machines used by Maricopa County.

  • The year of the big fraud:

Many Americans — according to some surveys, a majority — believe that the presidential election was marred by massive fraud in five states without which the President would surely have been re-elected.

    Snip.

This partisan fraud has been ongoing for at least two decades but is no longer escaping the attention of great deal of its erstwhile consumer base. For years we have been examining media disinformation and bias. This year it was particularly evident in the media’s discrediting the accurate reports of Hunter Biden’s corruption (and that of his father and uncle, who also benefited from it).

    Snip.

Add to this the media’s refusal to accurately describe the months-long BLM/Antifa riots, looting, arson, and killing, calling it instead “mostly peaceful protests,” it’s no wonder people are tuning them out. The heavy hand of the left wing played its part. Internet giants like Twitter suspended the account of the oldest newspaper in the country, the NY Post, which broke the story of the Biden family corruption with China, Russia, and the Ukraine as well as the account of the White House press secretary, and you can understand why “fewer than 15 percent of Americans trust the media.”

Treat your pen like a Democratic party weapon and be rewarded with pink slips to the unemployment line. “An estimated 28,637 job cuts were reported in the industry by late October, Variety, citing data from Challenger, Gray & Christmas, reported, nearly as many as the record 28,803 reported in the media sector in 2008. By comparison, the sector saw just over 10,000 job losses in 2019 and 15,474 in 2018.” The Hill attributes it to the China Virus. I think the mendacity and patent bias also has a great deal to do with the shrinking media employment.

  • An important part of the steal was the media’s complicity in covering it up:

Federalist Senior Editor Mollie Hemingway said on Fox News Thursday that allegations of a rigged election include big tech and big media conspiring to elect Joe Biden in addition to charges of voter fraud.

“We hear about the rigging of the election,” Hemingway said, “but partly what they mean is the meddling on the part of big media and big tech to affect the outcome of the election.”

Hemingway continued, pointing out that when major revelations about Democratic presidential candidate Joe Biden’s son, Hunter, began to surface implicating the former vice president in corrupt and potentially criminal overseas business activity, the stories were suppressed online by Silicon Valley tech giants and delegitimized by legacy media.

“When the New York Post broke the story about these emails,” Hemingway said, referencing the paper’s reporting from an abandoned Delaware laptop expanding the web of Biden’s scandals, “even though they were verified and people who were recipients of these emails verified they were real, the media suppressed that story.”

In October, the New York Post published a series of exposes revealing that Joe Biden stood to rake in millions from Chinese communist leaders, lied repeatedly when denying conversations about his son’s business, and leveraged his high-powered position to benefit the family. A Biden family business partner-turned whistleblower even came forward to corroborate details of the New York Post’s reporting.

The Post’s journalism that made Democrats look bad got the nation’s oldest paper locked out of its Twitter account for two weeks after the platform blocked users from sharing its blockbuster reporting.

  • A summary how how the steal was performed:

  • The left is trying to redefine opposition to election fraud as “sedition“:

It was inevitable that the Democrats would overreact to legal challenges by President Trump and other Republicans to corrupt election practices in swing states, but some responses have been unhinged even by their standards. One recurring refrain is particularly disturbing — that lawyers, members of Congress, and state attorneys general who supported post-election litigation are guilty of sedition. At least one Democratic congressman insists that attorneys representing the president in such challenges should be disbarred and that House members who supported Texas v. Pennsylvania in the Supreme Court shouldn’t be seated in Congress. One of the defendants in that ill-fated lawsuit described it as a “seditious abuse of the judicial process.”

This dangerous view of dissent has a long, sordid history among progressives.

  • Is election fraud China’s assassin’s Mace?

Election fraud is the secret “assassin’s mace” of the Chinese Communist Party (CCP) that has long confounded security hawks, according to tech billionaire and entrepreneur Patrick Byrne, who back in August assembled a cyber intelligence team to analyze the U.S. voting system.

“For 10 years or more, there have been references to a coming ‘assassin’s mace’ in the Chinese literature—where they take out the United States with one stroke,” Byrne told The Epoch Times’ “American Thought Leaders” program. “The national security community in the United States has been trying to figure this out: Is it their new aircraft carrier? Is that the hypersonic missile? Is it this, that, is it an EMP?”

“I don’t think so, ” he told host Jan Jekielek. “The one stroke that takes the United States out is what we’re experiencing right now.”

The 2020 vote involved “massive election fraud,” he says. “Not voter fraud, but election fraud.”

I doubt the “China did it” theory of election fraud, mainly because we’ve already seen the Democratic Party use these methods of fraud on a smaller scale (see Philadelphia) in past elections.

  • Despite the layoff, it’s been a busy week, so I have no doubt missed several election fraud stories. Please feel free to link to them in the comments.

    Texas Election Fraud Lawsuit Rejected

    Friday, December 11th, 2020

Well, so much for that hope of overturning massive election fraud:

The Supreme Court on Friday evening rejected a suit brought by the state of Texas seeking to challenge election results in Michigan, Wisconsin, Pennsylvania, and Georgia.

The Court wrote in an order that the lawsuit was denied for “lack of standing under Article III of the Constitution.

The lawsuit claimed that voting procedures in those four states were marred by irregularities that led to the election of Joe Biden as president. A group of 126 House Republicans, including Minority Leader Kevin McCarthy of California, signed on to an amicus brief in support of the lawsuit.

“Texas has not demonstrated a cognizable interest in the manner in which another state conducts its elections,” the Court ruled. “All other pending motions are dismissed as moot.”

I doubt any other lawsuit has a chance to stop the steal at this point, so we’re looking at the overwhelming likelihood Joe Biden will be sworn in as 46th President of the United States on January 20.

Election Fraud Update for December 7, 2020

    Monday, December 7th, 2020

We are rapidly approaching the endgame on election fraud remedies. States must ratify their final electors by December 8 (the “safe harbor” date), and electors meet and vote on December 14. Either the Supreme Court will have stopped the steal by that date, or Joe Biden will officially receive enough electoral votes to be elected President.

  • President Donald Trump lays out the case for significant voter fraud having altered the outcome of the 2020 Presidential election:

  • Here is a complete transcript of the speech.
  • Supreme Court Justice Samuel Alito has agreed to hear arguments that Pennsylvania’s loose mail voting requirements violated both state and federal law. Moreover, hearing it within the “safe harbor period by Tuesday “may signal that the Supreme Court takes Kelly’s case, which was rejected by the Pennsylvania Supreme Court with prejudice last weekend.”
  • The mysterious case of four suitcases of ballots pulled out from under a table after counting had supposedly stopped:

President Donald Trump’s legal team on Dec. 3 presented surveillance footage at a Georgia state legislature hearing that appears to show ballot-counting workers telling poll observers late at night on Election Day to leave before continuing to count and pulling out what appears to be boxes filled with ballots.

In the hearing on Dec. 3, Jacki Pick, a lawyer who is volunteering with the campaign’s legal case, said the team received video footage from State Farm Arena’s vote-tabulation center in Fulton County, Georgia. The team said that GOP poll watchers weren’t allowed to watch the counting process in the poll center.

According to Pick, an unusual occurrence took place later in the evening at around 10 p.m. local time: A woman—described as a blonde woman with braids—told workers to stop counting and notified everyone to go home.

Describing the video footage, Pick said, “Everyone clears out, including the Republican observers and the press, but four people stay behind and continue counting and tabulating well into the night.” The four counted unobserved until about 1 a.m., according to the video.

Pick said that video footage shows Fulton County election workers waiting at their scanning areas until GOP poll observers and reporters left the room before they started “scanning ballots,” ostensibly without any observation.

  • National Review‘s Rich Lowry says that there’s nothing nefarious going on. I’m not so sure.
  • Ruby Freeman and daughter/supervisor Wandrea “Shaye” Moss (involved in the suitcases full of ballots) are also involved in this video-captured thumb drive handoff:

  • “Whistleblowers Dispute Over 1 Million Ballots, Cite Dominion Tampering, Shipping Filled Ballots Across State Lines.”

The Amistad Project has gathered whistleblowers and sworn declarations revealing over one million potentially fraudulent swing-state ballots, including completed ballots getting shipped across state lines, postal service workers being told to prioritize Biden mail, and officials tampering with Dominion systems to prevent an audit.

In total, over 300,000 ballots are at issue in Arizona, 548,000 in Michigan, 204,000 in Georgia, and over 121,000 in Pennsylvania.

The declarations state that unlawful actions by state and local election officials in swing states, and possibly U.S. Postal Service officials,” the Amistad Project noted.

The evidence details “the failure of election officials in blue jurisdictions to maintain ballot chain of custody,” and include “photographs of individuals improperly accessing voting machines and a detailed eyewitness account of the breaking of sealed boxes of ballot jump drives and commingling of those jump drives with others.”

In addition to voting machine tampering, the Amistad Project’s findings reveal efforts by Postal Service officials in at least three of six swing states. “Details include potentially hundreds of thousands of completed absentee ballots being transported across three state lines, and a trailer filled with ballots disappearing in Pennsylvania,” the group notes.

The Amistad Project feels that one whistleblower, a USPS truck driver Jess Morgan, had “fraudulent ballots were mistakenly placed” in his Pennsylvania-bound truck.
